			<content:encoded><![CDATA[<p>In the state of Pennsylvania, <a href="http://www.lowabram.com/articles/medical-malpractice/">medical malpractice</a> lawsuits have been on the decline. In 2003, two different rule changes were implemented by the state Supreme Court, and consequently affected the number of malpractice liability suits that were filed.</p>
<p>Over the past nine years, medical malpractice lawyers have filed fewer lawsuits due to these rule changes. The new rules state that lawyers have to possess an official certificate that claims malpractice actually took place, and they have to file these suits in the actual county where the malpractice allegedly occurred.</p>
<p>In 2011, there were 1,528 medical malpractice lawsuits filed in the state of Pennsylvania. When compared to the number of malpractice suits that were filed before the law changes, the amount of current suits declined by 44.1 percent.</p>

<p>A jury in Philadelphia has just awarded $78.5 million to a  34-year-old woman who filed a medical malpractice lawsuit against the  hospital in which her son was born.</p>
<p>The expecting mother entered the hospital in 2008 claiming that she  was having difficulty with her pregnancy. A physician residing over her  care told the woman that her son was no longer living after having  performed an ultrasound. A second ultrasound was eventually approved,  and determined that the child was in reality still clinging to life.</p>
<p>A cesarean section was carried out, and the infant boy was born with  numerous birth injuries that directly led to the development of cerebral  palsy. The woman sued the hospital for negligence, and the jury sided  with the woman, and agreed that the prolonged response time was  connected to the birth injuries.</p>

The 45-year-old had been dating his dentist, and when he chose to end things with her, he still went back to her office when he began to experience a tooth ache just days later.</p>
<p>The 34-year-old dentist allegedly was going to act professional until she saw him, and then felt like she needed revenge. She administered a large dosage of general anesthesia, and then extracted all of the man&#8217;s teeth. Once he awoke, she lied to him and said that there were complications.</p>
<p>His entire head was bandaged when he left the dentist&#8217;s office, and he believed his ex-girlfriend would act professional in the situation, so he was looking into contacting a specialist. When he realized that he was completely toothless, he was outraged. A <a href="http://www.lowabram.com/practice-areas/medical-malpractice/">dental malpractice</a> investigation is underway, and if the dentist is found guilty she could spend up to three years in jail.</p>

			<content:encoded><![CDATA[<p>A new study that was published in Health Affairs reveals that doctors  lie to their patients on a more regular basis than what was once  previously thought.</p>
<p>There were 2,000 physicians who participated  in the study, that was focused on lying in the medical field. The  results showed that 34 percent of the doctors did not tell their  patients when a medical mistake occurred, and 20 percent of those  doctors chose not to divulge that information because they didn&#8217;t want  to be part of a <a href="http://www.lowabram.com/practice-areas/medical-malpractice/">medical malpractice lawsuit</a>.</p>
<p>The  results also indicate that 55 percent of the doctors that were surveyed  chose to put a positive spin on a patient&#8217;s diagnosis in order to have  it sound less grave, and over 10 percent of these physicians admitted  that they had told at least one white lie to a patient in the last year.</p>
<p>Researchers  believe that patients need to proceed with caution at their doctor&#8217;s  office, and make sure they ask the right questions in order to  understand their complete diagnosis, and not just the parts that their  doctor feels like sharing.</p>

<p>The  lawsuit stems from a 2009 delivery of a newborn girl that resulted in  brain damage and cerebral palsy. According to the girl&#8217;s parents, their  doctor should have acted in a more timely manner when delivering their  daughter. The girl&#8217;s heart rate dropped dramatically before birth, and  other complications caused her to develop brain damage.</p>
<p>The brain  damage led to cerebral palsy in the fragile girl. Now, the young girl  needs constant care and attention from her mother. She will require this  attention for the rest of her life. The medical costs associated with  cerebral palsy are high, and therefore they sought between $15 million  and $20 million in the lawsuit.</p>

			<content:encoded><![CDATA[<p>An 11-year-old girl was exiting a seafood restaurant in South  Philadelphia with her stepmother and 3-year-old stepbrother, when she  was killed by a motor vehicle that struck her and her family. The  accident happened on Sunday afternoon around 12:30 p.m. outside of  Captain Jesse&#8217;s Seafood restaurant.</p>
<p>Minutes before the <a href="http://www.lowabram.com/DUI-OUI-Accidents/">pedestrian accident</a>,  two motor vehicles ran into each other near the intersection of  Washington Avenue and 8th Street. An intoxicated driver ran a red light  and struck another motor vehicle. The driver who was under the influence  continued to lose control of his vehicle, and crashed into the young  family.</p>
<p>Paramedics pronounced that the young girl had died at the  scene of the accident. Her family members were transported to a hospital  in order to secure treatment for their varying injuries. They are both  said to be in stable condition. The driver that caused the accident  suffered a shoulder injury. He faces numerous charges against him,  including homicide while driving under the influence.</p>

The officials who made the arrests claim that documentation for at least 15 of these illegal transactions exists. The man&#8217;s 44-year-old wife faces charges of conspiracy in the scheme.</p>

<p>If a Pennsylvania driver is pulled over for violating this ban, a $50 fine will be given to them, if it is their first offense. With additional fees, the violation will cost approximately $135.50.</p>
<p>Critics of this ban believe that it will be almost impossible to enforce, and that police officers will find that the ban creates more of a burden than anything else. But, proponents of the bill hope that it will help decrease distracted driving in the state, which caused 14,000 car accidents in 2010.</p>

The 50-year-old mother of three claimed that her doctor failed to diagnose her with breast cancer in 2002 when she found a lump in her breast. She had a mammogram performed, but the doctor did not order any other tests to determine what the lump could be.</p>
<p>The woman waited another 16 months before returning to a doctor for another mammogram. She felt like the lump had not gone away. In fact, the lump had grown to the size of a golf ball, and was in fact malignant for cancer. She had to have a mastectomy, radiation, and several rounds of chemotherapy before she was put into remission for a short amount of time.
