Man Held for Trial in PA Husband’s Death

Posted on November 16th, 2009 No Comments

A Pittsburgh man accused of running over the husband of his ex-girlfriend, killing him, has been ordered to stand trial.

Thirty-five-year-old Bethel Park resident, Jason Kasper, was held on charges of homicide and homicide by vehicle. A charge of homicide by vehicle while under the influence was dropped.

According to police, Kasper dated Tracy Pavlick after she separated from 49 year-old John Pavlick last year. The couple reconciled and police say Kasper went to the Pavlick residence on November 1 after seeing the two of them at a Halloween party.

Police say Kasper drove his car onto John Pavlick, crushing him. Kasper told police that Pavlick jumped onto the hood of his car.

Patrick Thomassey, Kasper’s attorney, says it was an unfortunate accident fueled by alcohol.

Wrongful Death Suit Filed for Woman Who Died in Water Drinking Contest

Posted on October 27th, 2009 No Comments

The Philadelphia based Entercom Communication Corp. at its Sacremento subsidiary  have denied liability in the death of a woman who participated in a radio station water-drinking contest.

Entercom said that Jennifer Lea Strange’s death was not foreseeable. Prosecutor for Strange’s family, Roger A. Dryer, said the evidence against Entercom was “overwhelming.” The lawsuit claimed that Entercom’s corporate officials failed to train their management personnel properly. Dryer said that disc jokeys on KDND’s Morning Rave Show knew ahead of time about a 2005 water intoxication death at California State University, and were warned by callers during the show that there was potential danger in the stations “Hold Your Wee For A Wii” contest.

Still, Dryer said, the station changed the rules in the middle of the contest so as to double contestants water intake and failed to get medical care for Strange even though she vomited in the studio and complained of head pains. Dryer asked the jury to award his clients between $24.62 million and #34.45 million in restitution. Dryer asked the jurors to “understand the value of a mother. Understand and appreciate the value of a mother, a lover, a companion and a best friend.”

Family of Drowned Boy Files Wrongful Death Suit Against Pool

Posted on October 27th, 2009 No Comments

The family of a 9 year-old boy in Providence, Rhode Island has filed a wrongful death lawsuit against a city pool in Augusta after the boy drowned.

Jameson Auciel died on August 10, three days after he was pulled unconscious from the McGrane Pool in the city’s west end. Auciel’s 8 year old cousin, Gamaelle Bazelais, was also pulled unconscious out of the pool that day. Bazelais survived.

The lawyer for the Auciel family, Kenneth Schreiber, told reporters that the drowning was a “clear case of negligence.”

The city of Augusta has 40 days to issue a response to the claims. If the city does not respond, the family can file a lawsuit. City officials have stated that the pool was adequately supervised and deny and liability in the boy’s death.

Manual Pulmonary Resuscitator Recall

Posted on October 13th, 2009 No Comments

Medical device manufacturer Unomedical Inc. has announced a voluntary recall of its disposable manual resuscitators. The devices may be defective and unable to properly function as designed.

The Food and Drug Administration has partnered with the Texas-based company to recall the medical devices manufactured between July 2002 and March 2008. Neither of the two parties have said how many hand-held resuscitators are involved in the recall.

The resuscitators are single-patient devices used by healthcare professionals for patients requiring total or intermittent ventilatory support. The FDA said the products may malfunction and “create a situation in which the use of the product could potentially cause serious adverse health consequences or death.”

If you or someone you know has been injured by a defective product, it is important to get legal advice from an experienced attorney you can trust. Please contact the Pennsylvania Personal Injury Attorneys of Lowenthal & Abrams by calling 215-329-3511.
